Here is the straightforward breakdown of where things stand right now:

What is Section 781?
Passed in late 2025, Section 781 changes the federal definition of hemp from a Delta-9 standard to a strict 0.3% Total THC metric (including THCA). The enforcement date is currently scheduled for November 12, 2026.

Why the Seed Wording is Flawed:
The statutory text references "viable cannabis seeds" from plants exceeding 0.3% Total THC. However, cannabis seeds naturally contain 0% THC, 0% THCA, and 0% Delta-9.

Because an unsprouted seed contains zero cannabinoids, it cannot be chemically tested for Total THC. A seed cannot be categorized without germinating and growing the plant to maturity—making testing at the preservation stage scientifically impossible.

The Latest Pushback (H.R. 7010 / H.R. 7024):
This law is far from settled. Bipartisan legislation (The Hemp Planting Predictability Act) is actively advancing in Congress to extend the implementation timeline from 1 year to 3 years. If passed, this pushes the enforcement deadline out to November 12, 2028, alongside separate bills aiming for a full repeal (H.R. 6209).

Are Seeds Still Legal to Buy and Store?
