What is Section 781?

Why the Seed Wording is Flawed:
The statutory text references "viable cannabis seeds" from plants exceeding 0.3% Total THC. However, cannabis seeds naturally contain 0% THC, 0% THCA, and 0% Delta-9.

There has been a lot of discussion around the federal hemp ban (Section 781) and whether it changes the legal status of souvenir seeds. With the clock ticking, we wanted to drop a factual update for the GR420 community.

The "Mother Plant" Loophole Threatening Seeds
Passed in late 2025 and signed into law by President Trump, Section 781 explicitly redefines hemp. The new law states that hemp no longer includes viable seeds if they come from a mother plant exceeding 0.3% THC. This intentionally bypasses the scientific reality that an unsprouted seed naturally contains 0% THC, effectively reversing previous protections.

The Implementation Delay & Pushback
Originally, Senator Rand Paul secured a 365-day implementation period for this law, giving the industry until November 13, 2026, before enforcement begins.

Right now, a bipartisan group in Congress is pushing the Hemp Planting Predictability Act (H.R. 7024). If passed, this would push the enforcement deadline out two more years to November 2028. However, as of late July 2026, this extension has not yet advanced past committee.
